1. Subject and Definitions

This document (the "Terms") governs access to and use of the project management platform provided by Penola Group SRL, headquartered at B-dul. Vlad Țepeș 326, Romania.

"Services" means the set of software functionalities intended for organizing tasks, setting priorities, and monitoring the results of daily activities.

"User" is any natural or legal person who accesses or registers an account on the platform.

2. User Rights and Obligations

The User undertakes to provide accurate and complete information upon registration and to update the data whenever necessary.

It is forbidden to use the services for illegal, fraudulent purposes or that violate the rights of third parties. The User is solely responsible for the content uploaded and for the activities carried out through their account.

• Do not share passwords or login credentials.
• Comply with applicable data protection legislation.
• Do not attempt to access restricted areas of the platform.

3. Provider Rights and Obligations

Penola Group SRL undertakes to ensure the operation of the services at reasonable standards of quality and availability, except in cases of force majeure or scheduled technical interventions.

The Provider reserves the right to modify, suspend, or temporarily interrupt the services for updates, maintenance, or improvements, with prior notice of at least 48 hours.

3.1. Limitation of Liability

The Provider is not liable for indirect losses, moral damages, or interruptions of the User's activity caused by the use of the services.

The total liability of the Provider for any direct damage cannot exceed the value of the subscription paid by the User in the last 12 months.

4. Payments, Subscriptions, and Returns

Services are offered both on a free basis (with limited functionality) and through monthly or annual subscriptions, according to the plans published on the website.

Payments are made in advance, and amounts paid are non-refundable, except in cases provided by law or by the refund policy.

• Monthly subscriptions are automatically renewed, unless the User cancels at least 3 days before expiration.
• Annual subscriptions benefit from a 14-day cooling-off period from purchase, according to distance contract legislation.
• Any price changes will be communicated 30 days before implementation.

5. Confidentiality and Data Protection

The processing of personal data is carried out in accordance with the Privacy Policy available at policy.html.

The User expressly agrees to the collection and processing of data necessary for the provision of services, including contact data and usage information.

5.1. Data Security

The Provider implements appropriate technical and organizational measures to protect data against unauthorized access, loss, or destruction.

6. Duration, Termination, and Modification of Terms

These Terms come into effect upon acceptance by the User and remain valid for the entire duration of the use of the services.

The User may terminate their account at any time, with immediate effect, through the platform settings or by a written request to info@penolagroup.com.

The Provider may suspend or close the User's account in case of serious or repeated violation of the terms, with prior notice of 7 days.

• Changes to the terms will be communicated at least 15 days before implementation.
• Continued use after the changes come into effect constitutes acceptance of them.

7. Final Provisions

These Terms are governed by Romanian law. Any dispute will be settled amicably, and in case of failure, by the competent courts in Romania.
